Terms of Use

Talent Identification Platform (TIP) · Effective Date: May 19, 2026.

1. Acceptance of Terms

By accessing or using TIP, you agree to be legally bound by these Terms of Use, the Privacy Policy, and any additional policies referenced herein. If you do not agree, you must not use the platform.

2. Nature of the Platform

TIP is a technology platform providing tools and services relating to basketball training, coaching, scouting, athlete exposure, analytics, AI-generated insights, and commercial opportunities. TIP is not a sports governing body, agent, or recruiter.

3. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian. If you accept these terms on behalf of a minor, you warrant you are authorised to do so.

4. Accounts

You are responsible for:

Maintaining confidentiality of login credentials
All activity under your account
Providing accurate and up-to-date information

TIP may suspend or terminate accounts at its discretion.

5. Subscription Services

TIP may offer paid subscription tiers
Fees are billed in advance on a recurring basis
Unless required by law, fees are non-refundable
TIP may modify pricing or features with reasonable notice

Failure to pay may result in suspension or termination.

6. Commission & Marketplace Terms

TIP may facilitate introductions, transactions, or opportunities between users.

Where applicable:

TIP is entitled to a commission, referral fee, or service fee
Commission is earned upon successful connection, agreement, or transaction
Users must not circumvent TIP to avoid fees
TIP does not guarantee completion of any transaction

Users are responsible for contracting with third parties, tax obligations, and legal compliance.

7. No Agency or Representation

TIP does not act as a sports agent, recruiter, or representative unless expressly agreed in writing.

8. User Conduct

You agree not to:

Upload false or misleading information
Infringe intellectual property rights
Harass, abuse, or exploit other users
Circumvent platform payments or commissions
Use TIP for unlawful purposes

9. User Content

You retain ownership of content you upload but grant TIP a worldwide, royalty-free licence to use, display, and distribute it for platform operation and promotion.

10. AI Services

TIP provides AI-generated insights. These:

May be inaccurate or incomplete
Are not professional advice
Must not be relied upon solely for decisions

11. Third-Party Interactions

TIP is not responsible for conduct of users or third parties, failed transactions, or misrepresentations and disputes.

12. Termination

TIP may suspend or terminate access at any time for breach or risk management.

13. Limitation of Liability

To the maximum extent permitted by law, TIP is not liable for indirect or consequential losses, loss of opportunity or earnings, injury arising from training activities, or reliance on AI or platform content.

14. Indemnity

You agree to indemnify TIP against claims arising from your use of the platform, your content, or your breach of these terms.

15. Australian Consumer Law

Nothing in these terms excludes rights under the Australian Consumer Law.

16. Governing Law

These terms are governed by the laws of New South Wales, Australia.

17. Intellectual Property & Copyright

All content, design, code, branding, logos, features, and functionality of the TIP platform are the exclusive intellectual property of TIP and are protected by Australian and international copyright, trademark, and other intellectual property laws.

You must not:

Copy, reproduce, duplicate, or replicate any part of the platform
Reverse engineer, decompile, or attempt to extract source code
Create derivative works based on the platform or its design
Use TIP's branding, logos, or trademarks without prior written consent
Scrape, harvest, or systematically extract data from the platform

18. Updates

TIP may update these terms. Continued use constitutes acceptance.
